Mr. Gopal was introduced to the Committee and residents.

Strata Title
The President is advising residents to stop buying carpark as this will affect the strata title subdivision process, according to Pejabat Tanah Galian, Mr. Soh if car park is sold, it will alter the plan submitted to the relevant authority.

Forum
The relevant various departments, (Housing Department), YB, Yau and Developer, DBKL will be invited during the Forum. Expected forum will be held on last date of the month (28th September 2006).

Roof tile blown away by wind
Lousy work was carried out at the roof area. Proposed method of rectification was not carried out and work was done unprofessionally and endanger to residents safety.
There was no photograph taken during and after work done. Developer even requested Committee to furnish the photograph to them for insurance claims.

Sinking Fund
Lately some residents are receiving Warning Notice for outstanding sums, even though the amount was current.To seek clarification from Developer and YBR. Will also seek confirmation from Medan Idaman on the legality for them to collect Management fee.

Library
Managed to receive access key for the place, place was in a mess.

We have come to understand that there is a new Management Company taken over YBR Management Services Sdn Bhd. But the Residents & Committee have been informed officially of such change.

In view of the many complaints from the residents, we are highlighting the complaints:
Boom gates are malfunctions for the past three weeks
Badminton Courts Lights are out of service
The lights of at the fence are not functioning
Car parks light are not switched on at the appropriate timing (evening) after 7p.m.
The lift door of the 7th Floor of Block A cannot be fully opened
The personnel of the previous security company are found working again.
Swimming Pool facility had been abused. (Non Residents are using the facility to conduct swimming lessons.)
The library is still unfurnished and ceiling fan is faulty.

We would appreciate if you could provide a proper explanation and appropriate action to tackle against the above complaints in 14 days.

Agenda/Minute

1) General complaint to be officially put in writing in specified forms and submit to
Committees (two copies)

2) Library- Twice a week. To be discussed in detail by sub-committee, lead by Madam Lis and Puan Siti. Location of the library is informed to the residents. The sub-committee will organize a story telling session for children below 6years old. There is evidence that there is a duplication of access key at the Library room.

3) Pesta Tung Lung- YB Yew is inviting the resident of Idaman Sutera to attend the Pesta Tung Lung on the 5th October 2006 (Thursday), 7.30-10.30p.m. at Tapak Letak Kereta, Tmn Setapak Indah Jaya, Off Jalan Genting Klang, Setapak, 53300 Kuala Lumpur.

4) Family Day- to be organized after Raya, 7th January 2007 (High Tea)- Activities proposed is swimming competition, lucky draw, flower arrangement demonstration, chess and tug of war etc.

5) Car Park-The Building Management had installed a metal pole and chain to protect the unsold car park bay. The Committee will try to ensure that the installation cost will be only borne by Developer.

6) Gate Boom-spoilt. 30 % unpaid invoice, payment not paid, thus the Contractor is unable to come over to service the booms. (Even though, it is still under warranty).

7) New Building Management- Mr. Damu. (DG Management Services Sdn Bhd) has attended today. With regards to boom gate, the Developer will be releasing the payment by early next week.

Idaman Sutera Residents Association Meeting

Strata Title (ST)
Medan Idaman promised to resolve the ST in 9 months time effective from the last meeting.


Sinking Fund (SF)
Trustee fund. Not allowable to use for normal maintenance expense.
Medan Idaman (MI) Management accused YBR (Consultant) had wrongly advised them on the misuse of SF and require Committee to prove to them how the SF is misused.
Action Plan: The Committee would like to gather the strength of all residents to address the issues. Inviting YB Yau Tiong Lok to meet PTPK, PTG, DBKL, YBR to organize a dialogue session.
YBR is resigning as Property Management Company effective 31st August 2006.
YB Yau has promised to contribute 3 notice boards.
Proof of misuse of SF- Treatment of sewage pipe, replacement of swimming pool & garden bulbs, Charging exorbitant price.

Motorcycle Parking
Committee suggested to MI to relocate the guard house to the edge of entrance gate (for better control). Pave the walking space to convert to parking bay.


Car park
Committee has suggested to MI to open the unsold car park for rental. Rental for the car park is not finalized. Approximately RM 50 to RM 60. And requested MI to contribute 30% to 40% of the fund collected to the Management Account.

Security Guard
Old security guards are to be replaced on 28th August 2006. Five quotations are with the MI. To be finalized next month.

Miscellaneous Matter
Residents are using the apartment unit as a warehouse. Spotted cases are foreigners (suspected Chinese) using the apartment unit to store clothing materials.
-Garden lights are reconnected by our Residents (Mr. Wong) and temporarily functional.

Matters Discussed:
1) The Chairman mentioned that The Association has been dormant/in-active for one year. He proposed to cross check with Registrar Of Society (ROS) to verify the legal status of the Association, in order to comply to the rules, bylaws of Akta Pertubuhan 1966.
2) The next subsequent steps is compile all the outstanding reports and minutes from the Then Secretary, Norhaslinda. Mr. Cheah Chin Ngian has been requested to become the Acting Secretary until next AGM.
3) The COMMITTEE suggests to meet up with the Residents prior to the AGM, to explain and brief the Community of what happened to the Association inactivity. Soon after that, The Committee will determine an appropriate time to hold AGM. Expected to hold AGM in February 2008.
4) The Newly appointed Committee will continue with the Association onjective with the Management on the issues faced by Community.

Any other business.

Matters Discussed:

Minutes Of 20.11.07 was proposed and confirmed by Riati and it was seconded by Lim, it was unanimously approved by the Committee

Updates of ROS matters- Mr. Chairman has highlighted that the present Committee is still holding valid office, except for those Committee Members who has left the Idaman Sutera.

The Chairman has found that the present Membership Application Forms was too simple and it carries little information on the Residents.
Mr. Lim (The Treasurer) has raised doubt on the status of “Pemilik’ and “Penduduk”. Vice Chairman clarifies that the distinction of the rights of Owners and Tenant is that only Owners are eligible to stand for election to become Committee.

The Chairman quoted and explained on the flaws and weaknesses in the Rules
“ Members who fails to pay up the Fee are to be served with Reminder Letters and if the Fee is not paid within two (2) months (after February) from the said reminder, the Membership will be discontinued in due Bad Debts.”
The Chairman mentioned that The Committee will hold the discussion with the Members, and the new Members will be briefed on the Amendments of Association.
AOB
The Secretary raised up a question on those inactive Committee, The present Committee said those Absent Committee will be automatically ask to leave the Committee if they are found absent from office 3 times consecutively without tendering valid reasons.

Letter to YB Wee by Chairman

Dear YB WEE,
Congralulation on your appointment as our Wangsa Maju representative. We the residence of the above condominium which consist of 739 units have been facing a lot of problems from the Developer and it's appointed management company (as our strata title is still pending since 2002).Now they have send circulars to every owner's by hand or pos laju to form a Joint Management Body of Idaman Sutera,to be held on 6-4-2008.This is to adhere the Building And Common Property(Maintenance And Management) Act 2007.Which was gazette on 13/2/2007 and this formation has been over due.

It would be good for the parcel owners as they would know what the management is doing and have to be done to maintained the building to it's pristine condition. However they have not been maintaining the building properly. Till today for example the swimming pool is dirty, the sauna room is not working and the fire fighting equipment in every floor of the condo is not working or has has been expired and there is water leaking and water ponding in the common area and car park. We cannot understand why there is no routine check from the authorities. The management have not shown the account's since day one. The singking fund of RM150,000.00(2005) have been misused or missing.

Now just because of the law they are calling upon the all the parcel owners to form a Joint Management.In the past the Residence Association have had dozens of meetings with them together with Datuk Yew Teong Loke in 2006.We have sacrificed our effort time and money but they would not one to form a Joint Management and the Datuk interest was to request a land or office for his bilik gerakan in pursuing his political career what a cheek of him doing that. During that time Kementerian Perumahan Pengawasan was invited to visit our building and have meetings together with the developer but not even a single improvement have been made. At the end of the day the committee received threatening letters and our cars' have been sprayed, vandalised and punctured.

Todate just because of the law they have to obliged, however we are now worried as we do not know how much the management have been owing to the creditors, law suits and outstanding maintenance fees uncollected.

We hope that you could arrange a time for us to meet up with you as soonest possible or arrange a time to come and see the situation because we are not well verse with the law and the management together with the developer is always to their interest and benefit. Committee Meting

Dear YB WEE,

We are the temporary elected Pro-Temp committee, Foong Choong Ching and Lim Ang Choon, coincidentally are the present Registered Residents Association Of Idaman Sutera.

We would like to take this opportunity to thank your good self to spare your precious time to attend on the 6th April 2008. Thanks to your intervention, the proceeding of the said first Residents’ Meeting was postponed to such time to be determined by the Pro-Temp. We are grateful for what you have done for us. We OPPOSED the said meeting on the following grounds.

1) The Developer has already pre-selected candidates that are in favour of the Developer’s interest.
Proof: They have called upon selectively few residents to attend a meeting prior to the 6th April 2008’s meeting, which was held on 30th March 2008, no general posted on the notice board, it was only invited through telephones.
2) The meeting was not serving its’ purpose because it was hastily arranged or conducted.
Proof: The nomination process was not proper, as the house owners do not know each other well
3) We are fully aware and appreciate the good effort of developer by stationing so many security personnel to such extent that the residents are puzzled of their intention, we feel intimidated and threatened.
Proof: For a long time, we have not seen OUR SECURITY GUARDS carrying batons. And most of these NEW security guards are brought in from outside. They are treating the Residents like TERRORIST.
4) There is a registered Residents Association, under ROS in Idaman Sutera, which had conducted monthly meetings with Residents and Developers on Maintenance and Upkeeping of The Building, but the Developer had regarded this RA as illegitimate organization. The Committee has stopped being active due to a lawsuit being served to our President by one of resident.

Action
Before the Joint Management Committee is established, it is mandatory for the Residents to have access to the Developer Full Detail Account, which is supposedly to be transparent. WE are insisting on this account because the Strata Title Act, is in favour of the Developer.
Proof: JMC may sue or be sued in its name.

We sincerely hope that you would be able to attend the Residents and Parcel Owners Meeting to advise and provide guidance to resolve the Residents doubts and queries.
